The REAL ID Act was implemented nationwide by the US Department of Homeland Security in 2008.

This legislation established new guidelines for identifying cards and driving licenses.


On January 1, 2010, Florida began issuing credentials that complied with REAL ID. A star has been added to the top right corner of the new driver's licenses and ID cards to signify compliance with REAL ID requirements.

Residents renewing or obtaining a new driver's license or identity card in person are required by the REAL ID Act to provide certain documentation. Customers wishing to make their first in-person issuance after January 1, 2010, need to bring:

You legally changed your name (e.g., through marriage, divorce, or court order).


About Name Change

  • The marriage certificate or court order should indicate how their birth name changed to the current one.
  • If their name changed multiple times and the document shows both their current and birth names, they only need the final name change document.
  • If the final marriage certificate doesn't include both names, they must bring all documents that demonstrate the name change from birth to current name.
  • It's important that the name on their Social Security Number (SSN) matches the name on the Florida driver's license or ID card.

NOTEPeople who are U.S. citizens or immigrants, and are renewing, replacing, or applying for a new driver's license or ID card in person, must provide the necessary documents before receiving a REAL ID-compliant driver's license or ID card.


1 Primary Identification

U.S. Citizen Inmigrant Non-Inmigrant Canadian


An original of one of the following documents with complete name:

  • U.S. birth certificate, including some U.S. territories and District of Columbia (birth certificates from Puerto Rico must have an issue date after July 1, 2010);OR
  • Valid U.S. passport or passport card;OR
  • Consular Report of Birth Abroad;OR
  • Certificate of Naturalization, form N-550 or form N-570;OR
  • Certificate of Citizenship, form N-560 (Sample) or form N-561.

Notes:

  • Only a birth certificate issued by a county health department or the CDC Bureau of Vital Statistics will be accepted. Hospital birth certificates are not considered a certified document and will not be accepted.
  • Please come prepared to present one of the above listed identification documents as proof of citizenship or legal presence.
  • When applicable, marriage certificates, court orders or divorce decrees must be provided to link the name on the primary identification to the name on the driver license or ID card.
  • If a valid U.S. passport has the customer’s current name, they are not required to present additional name change documents.

Name Changes

Customers who have legally changed their name by marriage, divorce or court order must submit the original or a certified marriage certificate, divorce decree or court order. Photocopies are not accepted. Marriage certificates must be recognized by the state of Florida. Generally, marriage certificates issued in Florida or another state in accordance with the respective laws of those states are recognized by the State of Florida. Church-issued marriage certificates are not accepted.

NOTE Please allow 24 to 48 hours after changing your name with Social Security Administration before applying to change it with the Florida Department of Highway Safety and Motor Vehicles. Your name must verify with the Social Security electronic system to obtain a Florida driver license or identification card.

Certified copies of marriage certificates or divorce decrees may be obtained at the clerk of court in the county where it was originally filed.

An original of one of the following documents with complete name:

  • Valid alien registration receipt card (green card, form I-551); OR
  • I-551 stamp in passport or on I-94; OR
  • Immigration judge’s order, containing the customer’s A-number (admissions number), granting asylum with a valid passport; OR
  • I-797, containing the customer’s A-number, stating the customer has been granted asylum with a valid passport; OR
  • I-797, or another form from the United States Citizenship and Immigration Services (USCIS), with the customer’s A-number, stating the customer’s application for refugee status is approved with a valid passport. (Customers who have legally changed their name by marriage, divorce or court order must have their name changed on their USCIS documents.)

An original of one of the following documents with complete name:

  • Valid employment authorization card issued by the U.S. Department of Homeland Security (DHS) form I-688B or I-766;OR
  • Non-expired proof of non-immigrant classification provided by DHS form I-94 with required supporting attachment(s). If a customer is unsure of the required documentation, they should bring all United States Citizenship and Immigration Services (USCIS) documentation with them. (Customers who have legally changed their name by marriage, divorce or court order must have their name changed on their USCIS documents.)OR
  • I-94s must be accompanied by a valid passport with a date of entry stamp. Certain classifications require additional documentation. Some examples are:
    • F-1 and M-1 classification must be accompanied by an I-20;
    • J-1 or J-2 designation must be accompanied by a DS2019;
    • Refugee, asylee and parolee classifications must be accompanied by additional documentation;
  • I-571 (Sample) travel document/refugee travel permit with a valid passport;OR
  • I-512 parole letter accepted with a valid passport;OR
  • Immigration judge’s order granting asylum or cancellation of removal with a valid passport.

Notes:

  • Documents must be valid for more than 30 days from the date of issuance.
  • Non-U.S. citizens applying for an original driver license will be issued a 60-day temporary paper permit without a photo and a receipt. Non-U.S. citizens applying for an ID card will be issued a receipt. Upon identity and legal status verification, a driver license or ID card will be issued within 60 days and mailed to the address on the driver record. The driver license or ID card will be issued for the period of time specified on the USCIS document, up to a maximum of four years.
  • If lawful status or identification is not verified, a denial of issuance letter will be mailed to the customer.

An original of one of the following documents with complete name:

  • Valid Canadian passport;OR
  • Original or certified Canadian birth certificate;OR
  • Canadian naturalization certificate;OR
  • Canadian certificate of citizenship.

2 Proof of Social Security

An original of one of the following documents with complete name and complete SSN:

NOTE Non-immigrants or Canadians in the country without a work visa, do not need to get a letter from the Social Security Administration confirming that they were never issued a Social Security Number (SSN), which is also known as an SSA refusal letter.


3 Proof of Residential Address

Customers cannot use their current driver's license or ID card as proof of their residential address. Instead, they need to provide two different documents showing their Florida residential address (printed or faxed copies of these documents are acceptable).

Addresses from out-of-state or U.S. territories will no longer be accepted for individuals applying for a Florida Class E license or identification card.

Acceptable residential address documents include, but are not limited to:

  • Deed, mortgage, monthly mortgage statement, mortgage payment booklet or residential rental/lease agreement; OR
  • Florida voter registration card; OR
  • Florida vehicle registration or title; OR
  • Utility bill; OR
  • A utility hook up or work order dated within 60 days prior to the application; OR
  • Automobile payment booklet; OR
  • Selective service card; OR
  • Medical or health card with address listed; OR
  • Current homeowner insurance policy or bill; OR
  • Current automobile insurance policy or bill; OR
  • Educational institution transcript forms for the current school year; OR
  • Unexpired professional license issued by a government agency in the U.S.; OR
  • W-2 form or 1099 form; OR
  • Form DS2019, Certificate of Eligibility for Exchange Visitor (J-1) status; OR
  • A letter from a homeless shelter, transitional service provider or a half-way house verifying they receive mail for the customer. The letter must be accompanied by a Certification of Address form; OR
  • Mail from financial institutions including checking, savings, or investment account statements; OR
  • Mail from federal, state, county, or city government agencies; OR
  • FDLE registration form completed by local sheriff’s department.

Customers who don't have any of the mentioned documents in their name can provide two proofs of residential address from a parent, step-parent, legal guardian, or another person with whom they live, along with a Certification of Address form.

Following the REAL ID Act, customers are not obligated to present these documents for subsequent renewals unless there are changes in their information, such as name or address. However, if a customer is applying for a Commercial Learner’s Permit (CLP) or Commercial Driver License (CDL), they must present proof of residence documents as outlined below.


Proof of Residential Address for CLP and CDL Holders

Every applicant for a Commercial Learner’s Permit (CLP) or Commercial Driver License (CDL) must provide two proofs of Florida residential address in their name. They can either present two proofs from List A or one proof from List A and one proof from List B.


LIST A for CLP / CDL – item presented must be in the applicant’s name.

  • A recent lease or rental agreement for the residence with a term of 6 months or greater in the name of the driver (must be dated within the last six months);OR
  • Current Florida voter registration card;OR
  • Florida vehicle or vessel registration or title;OR
  • Current homeowner’s insurance policy or bill;OR
  • Current utility bill;OR
  • Recent cellular or landline telephone bill (must be dated within the last 60 days);OR
  • Recent internet service provider bill (must be dated within the last 60 days);OR
  • Latest property tax bill;OR

LIST B for CLP / CDL – item presented must be in the applicant’s name.

  • Latest W-2 form or 1099 form (must be dated within the last six months);OR
  • Recent bank statement (must be dated within the last 60 days);OR
  • Recent credit card statement (must be dated within the last 60 days);OR
  • Latest military orders;OR
  • Recent pay stub (must be dated within the last 60 days);OR
  • Recent official government documents.

Applicants for a Commercial Learner’s Permit (CLP) or Commercial Driver License (CDL) who cannot provide proof of residential address from List A must submit a Declaration of Domicile filed with the Clerk of the Circuit Court, following Florida Statutes section 222.17. Additionally, they need to provide one proof of residential address document from List B.

CLP & CDL applicants cannot use a Certification of Address (HSMV-71120) for licensure.
